SECTION 4 – ORDER ACCEPTANCE POLICY
All orders and subscription requests received are subject to acceptance by Peony Florist & Gift, and any of its personnel, reserve the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will offer store credit of equal value to your paid amount.
When ordering please enter the full address including the postcode of the recipient. We will not be held responsible for items that are not delivered due to incorrect details.
By completing your orders, you are consenting to be bound by our terms and conditions contained in these terms and conditions and appearing anywhere on the website.
Submitting your order is subject to our acceptance of this offer. we will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. we will not consider ourselves bound by a contract with you until we have issued this email confirmation.
We may require the order to be placed by 24 hours in advance.
Same-day orders are processed immediately, and usually cannot be changed. Due to the urgent nature of florist delivered products we are unable to cancel or change orders already in process at the florist, en route or delivered.
Any changes of particular (e.g. receiver’s address, messages, etc) must be made within 6 hours in advance or the day before.
Cancellation of orders will be subject to 20% handling/processing fee.
Delivery of Your Order
We provide same day deliveries for orders confirmed before 3pm.
Changes to Your Order
If you wish to change your order or subscription, please contact us via phone or WhatsApp at +6016-655 7488 / +6019 788 6335. We will do our best to accommodate last-minute changes for you, at our sole discretion, but acceptance of last-minute changes will not be guaranteed.

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

SECTION 21 – CANCELLATION POLICY
A processing fee of RM 5 or 5% of the amount paid (whichever is higher) will be imposed on each refund made. If you cancel your order due to an error that is not caused by us, we will offer you store credit of equal value to your paid amount. You can cancel by contacting email@example.com.
SECTION 22 – SUBSCRIPTION POLICY
If you wish to change your subscription, you can do so by signing in to your account on the Peony Florist & Gift website. You can pause or cancel a subscription at any time by providing notice to us by 9am the day before any intended delivery within your subscription plan. In such circumstances the pause or cancellation will take effect without charge. If your card has already been billed, we will issue a full refund.
Where notice is provided after that time, please note you will still receive and be charged for your next delivery, but your pause or cancellation instruction will take effect after that delivery. At peak periods we begin processing orders earlier than usual, to account for the large volume of deliveries. This means that we may need up to 5 days notice for any changes to be made.
The price for each order within a subscription is the price at the time that a subscription is set up. We reserve the right, at our absolute discretion, to raise our prices at any time for reasons including, but not limited to, price increases from our suppliers and partners. If we raise our prices, we will notify our subscribers and provide the option to cancel your subscription free of charge.
SECTION 23 – PAYMENTS
We accept Visa and MasterCard credit cards. In order to offer the best security, all our payments are processed securely by Adyen and MOLPay.
For all ongoing subscriptions, your credit will be billed upfront on checkout for the entire cost of the subscription.
If you create an account, your card will be stored securely so that you can check out on future visits without re-entering your card details.
We never store or have access to your credit or debit card details.
Section 24 – Self-Collect Policy
The self-collect option is available from Mondays to Saturdays except for public holidays, unless stated otherwise.
Please self-collect on your selected date during our operating hours from 9 AM – 5 PM (Mondays – Fridays) and 9 AM – 1 PM (Saturday), either in-person or via a representative (relative, friend, Grab Delivery and etc)
When self-collecting, you or your representative will be asked to show your order confirmation email which will contain your name, order number and other relevant details to prove your identity.
The latest time to do your self-collection will be 5 PM on your selected date. If you or your representative is not able to make it, do contact us at to assist with alternative arrangements.
If self-collection is not done and we have not received any request via call/WhatsApp from you by 5 PM on your self-collection date, your order will be disposed of for space and hygiene purposes.
SECTION 25 – DELIVERY POLICY
Our standard delivery service are completed between 10.00am – 6.00pm. In events of peak periods, our delivery services can be completed between 10.00pm – 8.00pm. Special delivery times may be requested subject to our acceptance.
We do not provide specific time deliveries, this is to maintain fairness to all of our customers, and in order to maintain the efficiency in our operations.
Although we always try our best to ensure punctual delivery for our customers, Peony Florist & Gift cannot be held responsible if a delivery is late due to unavailability of the delivery service that we use or anything else outside of our control.
In the event of a non-delivery, please contact us at firstname.lastname@example.org. It is the customer’s responsibility to contact us within 1 days of the scheduled delivery date in order to claim a refund. Failure to do so will result in the lapse of any rights to a refund.
Peony Florist & Gift only delivers within the Klang Valley at this moment. We can deliver to any address within stated region, but do not deliver to PO boxes.
We reserve the right, at our absolute discretion, to use a different delivery method without prior notification.
If you change address, you must update us your address to ensure that no deliveries are sent out to the wrong address. Please ensure this is done by 12 am one (1) day before the intended delivery day. We are unable to provide refunds for any deliveries sent to the wrong location where we have not received advance notice in accordance with this paragraph.
We require buyers to provide us with the receiver’s contact number in order to contact him/her for the collection of delivery. If by any chance that our dispatcher could not locate the receiver after several attempts, we and our collaborative dispatchers will not be liable for the failed delivery. Buyers are also responsible to let us know that we should not contact the receiver through our customer service platforms.
Buyers are required to notify us the timing that the receiver is not around or will leave the area in order for us to specify a remark to our collaborative dispatchers albeit the remark is not a guarantee or promise that the product(s) will reach at that particular/specific time slot. It is only a reference. We will only allow such order remarks for urgent matter. Casual requests (i.e.: preferences of time slot) will not be entertained.
The customer is responsible to ensure that your recipient is present at the address at the time of delivery. No refund will be issued if the flowers have been duly delivered to the address as prescribed by the customer. In the event a delivery is re-scheduled or re-routed upon the request of your recipient or you, a re-delivery fee will apply depending on your recipient’s location.
We will do our best to make sure that the receiver will receive the delivery on his/her own. however, we will not be able to do that if there is any restrictions by the receptionist or security guard of the building or neighbourhood.
We will not take responsibility for the late delivery due to adverse weather conditions, incomplete or incorrect delivery addresses, and any other causes beyond our reasonable control.
We reserve the right, at our absolute discretion, to cancel your order if it becomes apparent to us that the courier service in your area is too unreliable.
SECTION 26 – OFFERS AND PROMOTION CODES
We may offer products at discounted prices, from time to time, at our sole discretion. These offers are valid from the time that we introduce them to the end date of the offer and they cannot be used for purchases before the offer introduction date or after the offer end date.
In the event that a customer has made a purchase and the price of the purchased product subsequently falls or is discounted owing to a special offer, the price of the product at the time of purchase shall prevail. We are unable to offer special offer discounts for purchases that have already been made.
As our special offers are contingent on availability, we may change the terms of special offers, or withdraw them altogether, at any time, and without prior notice.
We also reserve the right, at our absolute discretion, to offer different personalized special offers and promotions and it will therefore only be possible for the customer in receipt of the special offer to redeem the discount.
Unless explicitly otherwise stated, free or discounted introductory offers are only available to new users of the Peony Florist & Gift service, and are only available once to any one person.
Discounts and credits cannot be used in conjunction with any other offers.
Unless otherwise stated, we only allow one promotion code to be used per order.
SECTION 27 – CIRCUMSTANCES BEYOND OUR CONTROL
Adverse Weather Conditions
During adverse weather conditions (including heavy rain and flood), our delivery partners may not be able to deliver orders on time. This is outside of our control and we cannot accept responsibility for the late delivery of the order. Therefore, in the event of adverse weather conditions, we aren’t able to refund or offer re-delivery of affected orders.
Peony Florist & Gift shall not be liable for delay in performing or for failure to perform its obligations if the delay or failure results from any of the following: (i) Acts of God, (ii) outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) the act of any government or authority (including refusal or revocation of any licence or consent), (iv) fire, explosion, flood, fog or adverse weather, (v) power failure, failure of telecommunications lines, failure or breakdown of plant, machinery or vehicles, (vi) default of suppliers, sub-contractors or delivery partners, (vii) theft, malicious damage, strike, lock-out or industrial action of any kind, and (viii) any cause or circumstance whatsoever beyond Peony Florist & Gift’s reasonable control.

SECTION 4 – SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 – THIRD-PARTY SERVICES

Peony Florist & Gift collect, hold and use information about you to enable us to provide you with our products and services. We also collect information about you to enable you to access our sites. We also use your information as required by law.
We may use your information to conduct direct marketing so that we can promote and market our products and services to you. We may conduct such marketing using electronic means. You can opt-out of receiving such marketing by contacting us. We do not sell your personal information to third parties for marketing purposes.

REFUND & RETURN POLICIES
As flowers are highly perishable items, it is impossible to make any return and refund, unless the flowers you receive is in an unacceptable form (product cannot be deemed as a bouquet anymore and/or most of the flowers are wilted when you received them). We aim to deliver all our flowers in fresh condition, and this would mean that they will sometimes come in bud form which will last much longer.
Should you receive flowers that do not seem fresh or have wilted, please contact us immediately via WhatsApp at +6016-655 7488 / +6019 788 6335 with photos of the wilted flowers within 24 hours of receipt in order to be eligible for a refund. Investigation and further action will be taken accordingly. If, at our discretion, the flowers do not meet our quality standards, you may have the choice of a replacement at our next available delivery date or a refund.
When filing your report, kindly provide us with your order number, several pictures of the defective product, and reasons on why are you requesting for a return or refund. In all other cases, it is the responsibility of the recipient to care for the flowers once it has been delivered.
Partial refund (if accepted by our management) will only be available as return postage costs and a handling fee may be applied depending on the situation.
It is the sender’s responsibility to inform the recipient of the delivery of the bouquet. We will not be liable for the safe receipt of the goods if they are left in a safe place at the buyer’s discretion with the dispatch. We will redeliver the goods if they are returned; if following a second attempt, we are still unable to deliver to the recipient, through no fault of our own, we are regrettably unable to offer a refund. Any remedy will be at our discretion.
We are not responsible for any orders where the recipient refuses to accept the goods. We will not issue refunds where the recipient, for whatever reason, will not accept the item or refuses delivery. This does not affect your statutory rights.
Kindly note that no refund or exchange is allowed once buyer has accepted the bouquet when he/she picked them up from us. The buyer is responsible to keep the bouquet fresh and in good condition. We will not be liable for the buyer’s neglect or mistreatment towards the bouquet. Please ensure that the bouquet is kept in a cool and well-ventilated area.
Returns Our policy lasts 7 days. If 7 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.
Please understand that due to the perishable nature of flowers, we are unable to accept returns. We offer customers refunds or replacement flowers if the flowers are not delivered to an acceptable condition, as detailed above.
Partial refund (if accepted by our management) will only be available as return postage costs and a handling fee may be applied depending on the situation.

You will bear your own postage costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return postage will be deducted from your refund.
You should consider using a trackable courier service or purchasing courier insurance. We do not guarantee that we will receive your returned item.
Damage in transit
Our flowers are packed carefully to ensure they arrive in good condition as when they left us. However, on a small number of occasions (and for reasons beyond our control) they may get damaged in transit. Should this occur to a level that you deem unacceptable, please inform us immediately via phone or WhatsApp at +6016-655 7488 / +6019 788 6335 in order for us to arrange a replacement at our next available delivery date, or a refund. Please note that you will need to email us a photo of the damaged flowers within 24 hours of receipt in order to be eligible for a refund.
Flower availability and substitution
All products are subject to availability. In the event of any supply difficulties on flowers that are needed to make up your order do not meet our quality standards, we reserve the right, at our absolute discretion, to substitute any product with an alternate product of a similar style and equivalent (or greater) value and quality.

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.
